TeamTreasurerUser Agreement
Preamble
TeamTreasurer is a online management software for fees and kitties of Clubs/Squads/Teams/Associations/Clans/Groups or any other societies. This service is designed to help the users to mangage kitty and fee data.
Owner and Operator from TeamTreasurer is Eduard Bruhl based in Thaleweg 33, 38723 Seesen (Germany).
Glossary
User/Member: The user of the TeamTreasurer software.
Treasurer: The creator of a team in TeamTreasurer.
1. Agreement
You agree that by clicking "Register Now" or similar, registering, accessing or using our services (including The TeamTreasurer Webservice, the TeamTreasurer Site (www.teamtreasurer.eu) collectively, "Services", "Service" or "TeamTreasurer"), to be bound by this web site user agreement. If you choose to not agree with this agreement, you may not use the Service.
2. Access to TeamTreasurer
Subject to your compliance with this User Agreement, TeamTreasurer hereby grants you permission to use the Service, provided that:
(2.1) you will only have one TeamTreasurer account
(2.2) your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the Service, or in any other manner inconsistent with this User Agreement;
(2.3) you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without TeamTreasurer's prior written authorization;
(2.4) you will not attempt to reverse engineer, spam, alter or modify any part of the Service; and
(2.5) you will not attempt to attack or hack the Service with the use of any automated system or other programms and tools.
3. Termination
TeamTreasurer has the right to terminate your access to any or all of the Services at any time if:
(3.1) TeamTreasurer believes that you may be in breach of this Agreement or law or are misusing the Services
(3.2) The last login of your account was over 360 Days
4. Service Availability
We may change, suspend or end any Service, or change and modify prices prospectively in our discretion. To the extent allowed under law, these changes may be effective upon notice provided to you.
5. Maximum Teams
You can join or manage maximal 10 Teams. Joining a Team is free.
6. Notifices
You agree that we may provide notices to you in the following ways:
(6.1) a notice message on the Service
(6.2) an email sent to an address you provided
7. Steps Purchasing an Upgrade
(7.1) Choose a Team
(7.2) Click on the 'Upgrade' Button
(7.3) Select the Type, Period and Currency
(7.4) Click on Continue. You will see a summary of the upgrade order
(7.5) If everything is okay, click BUY/PAY
(7.6) Upgrade is now purchased and active
8. Purchasing an Upgrade
If you purchase any of our paid Services ("Starter Upgrade" or "Business Upgrade"), you agree to pay TeamTreasurer the applicable fee. Failure to pay these fees may result in the termination of your access to any or all of the Services.
9. Bill delivery
The Bill after purchasing an upgrade will be delivered to your email address you provided.
10. Withdrawal after purchasing an Upgrade
Instructions on withdrawal
Right of withdrawal:
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us (Eduard Bruhl, Thaleweg 33, 38723 Seesen, Germany) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal:
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

11. Warranty Disclaimer
YOU AGREE THAT YOUR USE OF THE TEAMTREASURER SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, TeamTreasurer, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. TeamTreasurer MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SERVICE'S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY IN ANY EVENT FOR ANY:
(11.1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT,
(11.2) PERSONAL INJURY, PROPERTY DAMAGE, FINANCIAL DAMAGE OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE,
(11.3) UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN,
(11.4) INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE,
(11.5) BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE THROUGH THE ACTIONS OF ANY THIRD PARTY, AND/OR
(11.6) ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE TeamTreasurer SERVICE.
12. Limitation of Liability
IN NO EVENT SHALL TEAMTREASURER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY
(12.1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT,
(12.1) PERSONAL INJURY OR PROPERTY DAMAGE, FINANCIAL DAMAGE OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE,
(12.1) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN,
(12.1) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS,
(12.1) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY,
(12.1) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA TeamTreasurer, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND/OR
(12.1) THE DISCLOSURE OF INFORMATION PURSUANT TO THIS AGREEMENT OR PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
13. Law validity
You agree that the law of the federal republic of germany has validity.
14. Jurisdiction
Jurisdiction and venue for all disputes on the basis of this User Agreement shall lie (to the extent permitted by law) with the courts located at TeamTreasurer registered office.
15. Premium features
TeamTreasurer is currently developing some premium features. The purchase price is not yet defined because it will be calculated on the basis of future, income-dependent factors.
